Nebraska Supreme Court Rules on Vacation Pay
Mary Hewitt recently received a favorable decision from the Nebraska Supreme Court concerning accrued vacation pay. Specifically, the Supreme Court confirmed that Nebraska law requires an employer to pay accrued vacation upon separation of employment. By doing so, the Court leveled the playing field for employers who have historically paid accrued vacation to exiting employees in compliance with Nebraska law and those employers who have avoided paying vacation by arguing the issue was not clear. In light of this decision, employers should review their handbooks for compliance with the decision.
