EEOC Vaccination Updates

On December 16, 2020, the EEOC updated its COVID-19 related Q&A to reflect its newly established approach to employer mandated COVID-19 vaccinations. That new discussion can be found beginning at Section K in the link here. The discussion explains how employers may go about mandating employee vaccinations without violating various equal employment opportunity laws, most notably explaining how vaccinations can be mandated without violating the “medical examination” laws of the Americans with Disabilities Act. However, please be aware that whether or not you opt to mandate vaccinations in your workplace, various vaccination related issues are likely to arise that you may want to be prepared for.
