Pregnant Workers Fairness Act

On April 19, 2024, the Equal Employment Opportunity Commission (“EEOC”) published its final rule implementing the Pregnant Workers Fairness Act (“PWFA”), which applies to all employers with 15 or more employees. This final rule goes into effect on Monday, July 15, 2024 and can be found here, for any who want to read it. However, the EEOC published a shorter What You Should Know About the Pregnant Workers Fairness Act guide which summarizes the final rule and provides employers with a quick explanation of their obligations under the relatively new law. As a starting point, we encourage all our clients with 15 or more employees to review their handbooks and if necessary include a PWFA policy.
