On September 9, 2021 President Biden announced an executive order directing the Department of Labor to draft an emergency rule requiring that all businesses with 100 or more employees ensure all of their workers are either Covid vaccinated, or Covid tested once a week. This goes along with another executive order issued by the President requiring all government employees and employees of government contractors to be vaccinated against Covid-19, with no option of opting out through regular testing.
While there will be questions as to the legality of the first order, the order dealing with federal employees and contractors will require compliance. We will continue to monitor this development. But, if you are a federal contractor, you are most likely covered by the president’s order and you will need to issue a comprehensive policy dealing with this mandate so your employees know what to expect.
